Your rights and responsibilities when using our services.

1. Terms and definitions

1.1. Service – the "Tipse" service, available when using the site at: https://tipse.ge/ whose main function is to provide the technical possibility of transferring funds (tips) in non-cash form from the Tip Payer to the Tip Recipient.
1.2. User – any visitor of the Service. The Service divides three categories of Users, different in terms of the rights granted and responsibilities assigned – "Tip payers", "Tip Recipients" and "Managers".
Tip payer is an unregistered User of the Service who has the right to make voluntary and gratuitous money transfers (tips) using the functionality of the Service, as well as to leave feedback on the work of Tip Recipients.
Tip Recipient is a registered User of the Service who has the opportunity to receive money transfers (tips) from Tip Payers.
Manager - the manager of an institution (restaurant, beauty salon, etc.) is a registered User of the Service who has the ability to provide access to the Service to Tip Recipients, and monitors the received money transfers (tips) and reviews of the work of Tip Recipients within the institution of which he is the administrator.
1.3. Personal data – any information about the User obtained during the use of the Service.
1.4. The online payment system is a partner of the Service that provides the possibility of cashless transfer of funds (tips) from the Tip Payer to the Tip Recipient.
1.5. Confidential information – information transmitted by the User to the Operator in accordance with this Agreement, which includes, but is not limited to the following: commercial, contractual and financial information, as well as all documents and/or other information prepared in writing or otherwise by the User that reflect and/or include such information. The information subject to protection and non-disclosure in accordance with this Agreement does not include information posted by the User in open access on the resources of the Service and on other sites and services, as well as other information that cannot be confidential information in accordance with the current legislation of Georgia.

2. General provisions

2.1. LTD Project Blue (ID 404636747, hereinafter referred to as the "Operator") has developed and approved this "User Agreement". The User Agreement is an addendum to the "Tipse Personal Data Processing Policy", posted at: https://tipse.ge/ (hereinafter referred to as "Policy"). Everything that is not directly regulated by this User Agreement is regulated in accordance with the Policy.
2.2. The tip Payer is obliged to familiarize himself with this User Agreement before using the Service and accept its terms in full. The Tip Payer's disagreement with the terms of the User Agreement entails the inability to use the Service.
2.3. This User Agreement is a public offer within the meaning of Article 329 of the Civil Code of Georgia. The Operator provides the opportunity to use the Service from the moment of acceptance of the User Agreement and Policy.
2.4. Acceptance of this User Agreement and the Policy is carried out at the moment of going to the tip payment page or leaving feedback about the work of the Tip Recipient. The tip payer is notified that he agrees to the terms of the User Agreement and the Policy. If the payer does not agree with the terms of the User Agreement and the Policy, he must immediately leave the payment page.
2.5. The Tip payer can assume the transaction costs of the Service and the Tip Recipient by ticking the box "I want to assume the transaction costs so that the employee receives the full amount". The tip payer is notified that the specified check mark in the column is marked programmatically by default and the Tip Payer has the right to remove it from the column.
2.6. The tip payer is also obliged to familiarize himself with the user agreement of the Online Payment System - “Cleared Services LLC”, located at: https://payze.io/, and accept its terms of use in full. Acceptance of the user agreement of the Online Settlement System takes place on the website of the Online Settlement System at the time of the transfer of funds (tips) from the Tip Payer to the Tip Recipient. Refusal to accept the user agreement of the Online Payment System entails the inability to use the Service to transfer funds (tips).

3. Using the Tipse service

3.1. The Service provides informational and technological interaction between the Tip Payer and the Tip Recipient, providing the technical possibility of transferring funds (tips) in non-cash form from the Tip Payer to the Tip Recipient, as well as the gratuitous technical possibility of leaving feedback by Tip Payers about the work of Tip Recipients.
The service does not provide money transfer services (tips) and does not charge a commission for money transfer (tips). Money transfers (tips) are carried out by an online Payment system.
The service commission together with the acquiring commission is 7% and is displayed in the user interface of the Platform when paying tips.
The acquiring commission for the transfer of funds (tips) from the Payer to the Recipient, held by the Online Settlement System, ranges from 2.7% to 3.2%.
3.2. The maximum size of one transaction is 500 Lari.
3.3. The transfer of funds (tips) from the Tip Payer to the Tip Recipient is a donation of funds from one individual to another individual.
If the Tip Payer uses the Service to transfer funds for purposes other than the transfer of tips, the obligations and responsibility for calculating and paying any taxes and fees provided for by law arising from the misuse of the Service are assigned to the Tip Payer. The Operator is not responsible for the purpose and purpose of transferring funds from the Tip Payer to the Tip Recipient.

4. Rights and obligations of the Tip Payer and the Operator

4.1. The tip payer has the right to:
4.1.1. use the functionality of the Service in accordance with the User category assigned to it;
4.1.2. transfer Confidential information to the Operator in order to perform actions necessary for the use of the Service;
4.1.3. refuse to receive informational messages by sending a notification to the Operator at the email address support@tipse.ge;
4.1.4. contact the Service support with questions, claims and suggestions related to the operation of the Service by sending an email to: support@tipse.ge . The deadline for submitting claims is 3 (three) working days from the date of the occurrence of the event in connection with which the claim is sent.
4.2. The tip payer undertakes:
4.2.1. provide reliable, up-to-date, accurate and complete information when using the Service. At the same time, the Tip Payer agrees that the Operator is not obliged to verify the accuracy of the information provided by the Tip Payer;
4.2.2. not to perform actions on behalf of another real or existing person, not to indicate personal information of third parties, not to use information of third parties in any other way that does not comply with the requirements of the legislation of Georgia. The Tip Payer is responsible for these actions, including those that caused losses to the Service.
4.3. The Operator has the right to:
4.3.1. change the terms of the User Agreement in accordance with clause 5.4 of this User Agreement;
4.3.2. refuse to use the Service at any time to the Tip Payer. Refusal to use the Service entails the inability to use the Service to transfer funds (tips). The Operator is not obliged to disclose to the User the reasons for refusing to use the Service;
4.3.3. to involve third parties in order to achieve the purposes of using the Service, in compliance with the confidentiality conditions and other conditions stipulated by this User Agreement.
4.4. The Operator undertakes:
4.4.1. provide the Tip Payer with the opportunity to use the Service in accordance with this User Agreement;
4.4.2. to maintain the operability of the Service, except in cases when it is impossible for reasons beyond the Operator's control;
4.4.3. to ensure the safety and non-disclosure of Confidential Information provided by the User in accordance with this Agreement. The Operator undertakes not to disclose, provide, distribute, discuss or reproduce Confidential Information to any person without the express consent of the Tip Payer, except in cases provided for by the legislation of Georgia or the Agreement.

5. Final provisions

5.1. This User Agreement comes into force from the moment of its acceptance in accordance with the procedure established in clause 2.4 of the User Agreement.
5.2. Acceptance of this User Agreement expresses the Tip Payer's full agreement with the terms of the User Agreement.
5.3. The Operator is not responsible for the services provided by third parties, including Service partners.
5.4. The User Agreement may be amended by the Operator by posting a new version of the User Agreement on the Service's website. The tip payer undertakes to independently periodically check this User Agreement for changes (the document indicates the date of its publication). Changes to the User Agreement made by the Operator come into force on the day of publication of the new version of the User Agreement. The Tip Payer has the right to refuse to accept changes and additions to this User Agreement, which means that the Tip Payer refuses to use the Service.This User Agreement is published on the official website of the Operator at: https://www.tipse.ge/.
5.5. In case of any disputes or disagreements, the parties establish a mandatory pre-trial procedure for filing a claim. The term of consideration of the claim is 30 calendar days from the date of receipt to the Operator. If disputes or disagreements are not resolved by the parties, they are subject to consideration in the Arbitration Court of Tbilisi in accordance with the jurisdiction of the court and in accordance with the procedure established by the legislation of Georgia.
