How Tipse collects and uses data

1. Terms and definitions

1.1. Service – the "Tipse" service, available when using the site at: https://tipse.ge/ whose main function is to provide the technical possibility of transferring funds (tips) in non-cash form from the Tip Payer to the Tip Recipient.
1.2. User – any visitor of the Service. The Service divides three categories of Users, different in terms of the rights granted and responsibilities assigned – "Tip payers", "Tip Recipients" and "Administrators".
Tip payer is an unregistered User of the Service who has the right to make voluntary and gratuitous money transfers (tips) using the functionality of the Service, as well as to leave feedback on the work of Tip Recipients.
Tip Recipient is a registered User of the Service who has the opportunity to receive money transfers (tips) from Tip Payers.
The Administrator (administrator of an institution (restaurant, beauty salon, etc.) is a registered User of the Service who has the ability to provide access to the Service to Tip Recipients, and monitors the received money transfers (tips) and reviews of the work of Tip Recipients within the institution of which he is the administrator.
1.3. Personal data – any information about the User obtained during the use of the Service.
1.4. The online Payment system is the partner(s) of the Service that provides the possibility of cashless transfer of funds (tips) from the Tip Payer to the Tip Recipient.
1.5. Confidential information – information transmitted by the User to the Operator in accordance with this Agreement, which includes, but is not limited to the following: commercial, contractual and financial information, as well as all documents and/or other information prepared in writing or otherwise by the User that reflect and/or include such information. The information subject to protection and non-disclosure in accordance with this Agreement does not include information posted by the User in open access on the resources of the Service and on other sites and services, as well as other information that cannot be confidential information in accordance with the current legislation of Georgia.

2. General provisions

2.1. LTD Project Blue (ID 404636747, hereinafter referred to as the "Operator") has developed and approved this Personal Data Processing Policy (hereinafter referred to as the "Policy").
2.2. This Policy applies to all information that can be obtained about the "User" during the use of the site, available at: https://tipse.ge / (hereinafter referred to as "Service").
2.3. The User is obliged to familiarize himself with this Policy before using the Service and accept this Policy in the manner specified in clause 3.3 of this Policy. By accepting the Policy, the User expresses unconditional consent to the provision of Personal Data and their subsequent processing by the Operator. Disagreement with the terms of the Policy entails the inability to use the Service.
2.4. The Service may contain links to third-party sites and automatically navigate to third-party sites. The Operator is not responsible for the confidentiality of Personal Data when accessing such sites or when interacting with third-party services. The User must familiarize himself with the Personal Data processing policy of such sites and services.

3. Processing of personal data

3.1. In order to provide the User with access to the use of the Service, the Operator processes Personal Data, including through their collection, recording, systematization, accumulation, storage, clarification, extraction, use, transfer, depersonalization, blocking, deletion and destruction of the User's Personal Data.
3.2. The User agrees that the Operator has the right to transfer (provide) User's personal data to third parties – partners of the Service, including: https://payze.io/, https://auth0.com/. Such data transfer is necessary in order to ensure the functioning of the Service, its administration, refinement and technical support.
3.3. The adoption of this Policy is carried out:
By the tip payer when switching to the Service in order to pay a tip or leave a review about the work of the Tip Recipient. Before performing actions to pay for tips and leaving a review, the Payer must study the content of the Personal Data Processing Policy and the Tip User Agreement. By clicking on the Payment button or the Feedback button, the payer automatically accepts the terms of the User Agreement and the Personal Data Processing Policy.
The recipient of the tip by filling out the registration form on the website. When performing registration actions, the Tip Recipient ticks the boxes "I accept the terms of use of the Tipse platform" and "I agree with the personal data processing policy".
By the administrator by logging into the personal account on the Service website using the generated username and password. When performing registration actions, the Administrator ticks the boxes "I accept the terms of use of the Tipse platform" and "I agree with the personal data processing policy".
3.3.1. The processed Personal Data of the Tip Payer includes:
information about the payment system (MasterCard, Visa, etc.) Tip payer, payment type (contactless / entering card details), card mask (PAN), device type (Android/Apple), information about the institution where the transaction was made, the time and amount of the transaction for the purposes of collecting analytical data to improve and refine the Service;
depersonalized data (user session data - a sequence of requests made by the Tip Payer while using the Service) obtained when accessing the Service using Internet statistics services for the purposes of collecting analytical data for improving and refining the Service.
3.3.2. The processed Personal Data of the Tip Recipient includes:
the surname, the name of the Tip Recipient for contacting him, as well as for identifying the Tip Recipient by Tip Payers;
the contact mobile phone number of the Tip Recipient to send him information, advertising messages, as well as to contact the Tip Recipient;
an image for the Tip Recipient's profile / photo for the Operator to ensure the functioning of the Service and for the identification of the Tip Recipient by Tip Payers before making a transaction or leaving a review;
information about the type of device (Android/Apple), information about the institution where the Tip Recipient receives transactions, the time and amount of transactions, information about the mask of the Tip Recipient's card for the purposes of collecting analytical data to improve and refine the Service;
depersonalized data (user session data - a sequence of requests made by the Tip Recipient while using the Service) received when accessing the Service using Internet statistics services for the purposes of collecting analytical data for improving and refining the Service.
3.3.3. The processed Personal data of the Administrator includes:
surname, name of the Administrator for contacting the User;
the contact number of the Administrator's mobile phone for sending information, advertising messages, as well as for contacting him;
depersonalized data (user session data - a sequence of requests made by the Administrator during the use of the Service) obtained when accessing the Service using Internet statistics services for the purpose of collecting analytical data to improve and refine the Service.
3.4. Purposes of Personal Data processing
3.4.1. Tip payers:
provision of access to the Service, operation of the Service;
providing customer and technical support in case of problems related to the use of the Service;
Service management, administration, improvement, refinement and technical support;
other goals that do not contradict the current legislation of Georgia, public interests, the foundations of law and order and morality, conditioned by the terms of the User Agreement between the Operator and the User.
3.4.2. Tip recipients:
provision of access to the Service, operation of the Service;
creating an account to use the Service;
verification of the account belonging to the User to limit abuse and violations of the rights of the User or other persons;
identification of the Tip Recipient by Tip Payers;
establishing feedback for the purpose of using the Service, processing requests and requests from the User;
sending notifications, requests regarding the use of the Service and its functioning;
providing customer and technical support in case of problems related to the use of the Service;
provision of special offers, newsletters, advertising (marketing) and other information on behalf of the Operator or on behalf of the Operator's partners;
Service management, administration, improvement, refinement and technical support;
other goals that do not contradict the current legislation of Georgia, public interests, the foundations of law and order and morality, conditioned by the terms of the User Agreement between the Operator and the User.
3.4.3. Administrators:
provision of access to the Service, operation of the Service;
establishing feedback for the purpose of using the Service, processing requests and requests from the User;
sending notifications, requests regarding the use of the Service and its functioning;
providing customer and technical support in case of problems related to the use of the Service;
provision of special offers, newsletters, advertising (marketing) and other information on behalf of the Operator or on behalf of the Operator's partners;
Service management, administration, improvement, refinement and technical support;
other purposes that do not contradict the current legislation of Georgia, public interests, the foundations of law and order and morality, stipulated by the terms of the User Agreement between the Operator and the User.
3.5. The Operator processes the User's Personal Data only if they are sent by the User through the forms located on the Service's website.
3.6. Depersonalized User data (user session data - a sequence of requests made by the User while using the Service) collected using Internet statistics services are used to collect information about User actions on the site, improve the quality of the Service and its content. The Operator processes depersonalized data about the User if it is allowed in the User's browser settings.
3.7. The Operator takes technical, organizational and legal measures to ensure the protection of the User's Personal Data from unauthorized or accidental access, deletion, modification, blocking, copying and dissemination of Personal Data.
3.8. The period of processing of Personal Data is unlimited. The User can withdraw his consent to the processing of Personal Data at any time by sending a notification to the Operator to the email address support@tipse.ge marked "Withdrawal of consent to the processing of personal data".
3.9. If the User withdraws consent to the processing of Personal Data, the Operator has the right to continue processing Personal Data without the User's consent if there are grounds provided for by the legislation of Georgia.
3.10. The Operator has the right to delete the User's account or the information posted by the User, thereby terminating the processing and storage of the User's Personal Data. The Operator is not obliged to disclose to the User the reasons for such deletion of the User's Personal Data.


4. Rights and obligations of the User

4.1. The User has the right to access his Personal Data processed by the Operator.
4.2. The User has the right to refuse to receive information messages at any time by sending a notification to the Operator to the email address:
support@tipse.ge 4.3. The User has the right at any time to restrict access to his Personal Data in its entirety by refusing to use the Service, in whole or in part in part, provided that the use of the Service will be possible without access to the relevant data by sending the Operator a notification to the email address: support@tipse.ge .
4.4. In case of inaccuracies in Personal Data, the User is obliged to update them by sending a notification to the Operator to the email address: support@tipse.ge marked "Updating of personal data". The Operator does not verify the data received from the User, except in cases when such verification is necessary to fulfill the obligations of the Operator to the User.

5. Final provisions

5.1. The law of Georgia applies to this Policy and relations with the User in the field of Personal Data.
5.2. The User can receive any clarifications on issues of interest concerning the processing of his Personal Data by sending an appeal to the Operator to the email address: support@tipse.ge . For effective processing of requests in the text of the letter, it is necessary to indicate this Policy and acceptance of its terms.
5.3. The Policy may be changed by the Operator by posting a new version of the Policy on the website and in the Service application. The User undertakes to independently periodically check this Policy for changes (the document indicates the date of its publication). Changes to the Policy made by the Operator come into force on the day of publication of the new version of the Policy. The User has the right to refuse to accept changes and additions to this Policy, which means that the User refuses to use the Service. The refusal to use the Service is carried out as follows:
The Tip Payer does not accept the Policy in the current version and does not use the Service's capabilities to transfer funds (tips) in non-cash form from the Tip Payer to the Tip Recipient.
The Tip Recipient and the Administrator send the Operator a notification to the email address: support@tipse.ge
The Operator processes the notification within 7 (seven) business days and disconnects the Tip User from the Service.
